Shanghai Anytum Network Technology Co., Ltd. (Hereinafter referred to as "Mobi Fitness" or "We") attaches great importance to the protection of your personal privacy and information. We have formulated strict measures to manage your personal information in accordance with the requirements of laws and regulations. In order to provide you with more accurate and personalized services, we will use and disclose your Personal Information in accordance with the provisions of this Agreement. Before using the MobiFitness App or the services provided by us, you must carefully read and make sure that you have fully understood the relevant content of this Agreement. 1. How do we collect and use your information

 

1.1 How do we collect your information

When you use products or services provided by us, we may collect, store and use the following information:

 

1.1.1 Information provided by you

A. The personally identifiable information you provide to us when you register, log in, or complete your personal information to use our Services, such as email address, gender, height, weight, etc.

B. Shared Information that you provide to other parties through our Services, and information that you upload, submit, store, send or receive when using our Services.

 

1.1.2 Information obtained by us during your use of the Services

We will collect information about the services you have used and how to use these services, such as information that may be generated when you use our hardware products to cooperate with MobiFitness App for exercise. Such information includes:

A. Device Information: We will receive and record information related to the device you use, such as software version, device Settings, screen resolution and other hardware and software characteristics, as well as information related to the location of the device, such as IP address, GPS location and sensor information such as WLAN access point, Bluetooth and base station that can provide relevant information, according to the specific permissions you authorize during the software installation and use. If you refuse to grant us the corresponding permissions during installation and use, we will not record the above corresponding information.

B. IP address: including information about the App you have used and the information you communicate through our services.

C. Barcode scanning: When you use the barcode scanning function, we will access the relevant permissions of your device camera. At the same time, you can also refuse/cancel this permission at any time through the relevant function Settings. Refusal to provide this permission will only make you unable to use the above functions, but it will not affect the normal use of other functions and services of MobiFitness App; However, when you cancel this authorization, we will no longer collect this information, nor will we be able to provide you with the above-mentioned corresponding services.

D. Location Information: You may authorize to turn on the device location function and use the relevant services provided by us based on location. You may also stop us from collecting your geo-location information at any time by turning off the location function. At the same time, you can also refuse/cancel this permission at any time through the relevant function Settings. Refusal to provide this permission will only make you unable to use the above functions, but it will not affect the normal use of other functions and services of MobiFitness App; However, when you cancel this authorization, we will no longer collect this information, nor will we be able to provide you with the above-mentioned corresponding services.

E. Bluetooth: If you already have relevant hardware devices (whether related to Mobi or not) and want to synchronize the information recorded by hardware products (including but not limited to heart rate, exercise data and other personal information and personal body data that have been agreed to be uploaded) to MobiFitness App, you can do so by turning on Bluetooth function. At the same time, you can also refuse/cancel this permission at any time through the relevant function Settings. Refusal to provide this permission will only make you unable to use the above functions, but it will not affect the normal use of other functions and services of MobiFitness App; However, when you cancel this authorization, we will no longer collect this information, nor will we be able to provide you with the above-mentioned corresponding services.

F. Non-personal information: we may also collect other information that is not personally identifiable to a specific individual and does not belong to personal information according to local Applicable laws, such as statistical data generated when you use a specific service, such as day live events, page access events, page access duration events, session events; Network monitoring data, such as the request time and the number of request and error; And an Application crash event. The purpose of collecting such information is to improve the services we provide to you. The type and amount of information collected depends on how you use our products or services.

In addition, we collect information such as device model, system version number and other information related to your activities in our mobile Application. We aggregate such information and use it to help us provide users with more useful information about which aspects of our products or services they are most interested in. For the purposes of this Privacy Agreement, aggregate data is considered non-personal information. If we use non-personal information in combination with personal information, then such information will be treated as personal information for the duration of such combination.

We collect your information for the purpose of providing you with the corresponding products or services and ensuring that we comply with Applicable laws, regulations and other normative documents. We may use the information collected above for the following purposes:

A. Provide, process, maintain, improve, develop our products or provide services to you;

B. Used for authentication, customer service, security prevention, fraud detection, archiving and backup purposes when we provide the Services to ensure the security of the Products and Services we provide to you;

C. Internal purposes, such as statistical information related to your use of our products or services, to better improve our products or services;

D. To help us design new services and improve existing services;

E. To enable us to better understand how you access and use our services, so as to respond to your personalized needs, such as speed unit setting, etc.;

F. Provide software verification and upgrade services;

H. Invites you to participate in surveys regarding our products and services;

I. Store and maintain information related to you for use in our business operations or to fulfill our legal obligations;

J. Other purposes for which your consent has been obtained.

 

1.3 Our Commitment

We will not sell your Personal Information to any third party at any time and under any circumstances, and we will only use the information obtained under this Agreement to the extent permitted by law. We have strict policies to protect your personal information, and we will not disclose your personal information or provide it to third parties unless we have obtained your prior authorization or otherwise stipulated in this Statement.

 

1.4 For iOS users

If you use an iphone, we will send your exercise data to Apple's Heathkit after your authorization. Your exercise data generated in MobiFitness App will be synchronized with Apple's Heathkit in order to count the exercise consumption.

 

1.5 Relevant laws, regulations and national standards

In accordance with relevant laws, regulations and national standards, we may collect and use your personal information in the following situations without asking for your authorized consent:

A. Those directly related to national security, national defense security and other national interests, and those directly related to public security, public health, public knowledge and other major public interests;

B. Those directly related to criminal investigation, prosecution, trial and execution of judgment;

C. For the purpose of protecting your or other personal life, property, reputation and other important legitimate rights and interests, but it is difficult to get your consent;

D. The Personal Information collected is disclosed by you to the public;

E. Collection of personal information from legally publicly disclosed information, such as legal news reports, government information disclosure and other channels;

F. Necessary for signing and performing the Contract as required by you;

G. Those necessary to maintain the safe and stable operation of the products or services provided, such as finding and dealing with faults of the products or services;

H. Necessary for carrying out legitimate news coverage;

I. It is necessary to carry out statistical or academic research in the public interest, and when the results of academic research or description are provided to the outside world, the personal information contained in the results is de-identified;

J. Other circumstances provided by laws and regulations.

Please understand that the functions and services we provide to you are constantly updated and developed. If a certain function or service does not Appear in the foregoing instructions and needs to collect your information, we will separately explain the content, scope and purpose of information collection to you through prompts on the page, interactive procedures and other means to obtain your consent.

 

1.6 Anonymization of personal information

After collecting your personal information, we will anonymize the data through technical means in a timely manner. Without disclosing your personal information, MobiFitness App has the right to mine, analyze and utilize the anonymized user database (including commercial use), and to conduct statistics on the use of products/services and share desensitization statistics with the public/third parties.

 

2. How do we update, change, delete and export your information

By the law of some jurisdictions:

A. When using our products and services, you will be required to provide your true personal information, you shall be responsible for the authenticity, legality, validity and integrity of the information you provide, and you shall timely update and maintain your personal information to ensure that the information is true, legal and effective. You can manage your personal information at any time, such as your personal account registration information.

B. You can request us to delete or modify your information, for example, if you want to delete your personal account, you can send an email to support@mobisport.com to contact us and put forward your request, we will contact you within 15 working days after receipt of the check and processing. After deleting your personal account, you will not be able to use all products or services of MobiFitness App. Please consider carefully.

C. In some cases, we retain data for a limited period of time for legal purposes or legitimate business purposes. We do our best to ensure that our services protect information from accidental or malicious deletion. Therefore, if you remove certain content, we may remove copies of it from our current and standby systems within 15 business days.

D. You may revoke your consent previously granted to us for a specific purpose, including the collection, use and disclosure of your Personal Information in our possession or control, by submitting a request. You can do so by sending an email to support@mobisport.com. We will process your request within a reasonable period of time after you make the request, and will no longer collect, use or disclose your personal information upon your request. At the same time, depending on the extent to which you withdraw your consent, you may not be able to continue to enjoy the products or services of MobiFitness App, but your decision to withdraw your consent or authorization will not affect the effectiveness of our previous personal information processing activities based on your consent.

 

3. How do we store your information

3.2 Term of information storage

In general, we retain your personal information only for as long as is necessary for the purpose, such as:

Email Address: If you need to use MobiFitness App service, we need to keep your email address at all times to ensure your normal use of the service. After deleting your personal account, we will no longer save the relevant information.

When the operation of our products or services is stopped, we will notify you through App push, announcement and other forms, and delete your personal information or anonymize it within a reasonable period of time. 

 

4. How do we share or publicly disclose your information

We do not sell any personal information to third parties.

We may sometimes share your Personal Information with third parties for the purpose of providing or improving our products or services, including providing products or services upon your request. If you no longer wish us to share this information, please contact us by email at support@mobisport.com.

  

4.1.1 Sharing with third-party service providers and business partners

We may share necessary personal information with third parties such as third party service providers and business partners, including our logistics providers, data centers, data storage facilities and other business partners, in order to ensure that we provide you with the services described for the purpose of this Privacy Agreement. We guarantee that we will share the Personal Information necessary to provide the Services to you only for legitimate, lawful, necessary, specific and explicit purposes. MobiFitness App will conduct due diligence and enter into contracts to ensure that third party service providers comply with Applicable privacy laws in your jurisdiction. Third-party service providers may also have their child handlers.

At present, SDKs of third-party service providers we access include the following types:

A. You Meng SDK, used for message push function.

We will only share your information for legitimate, necessary and specific purposes. For the third party service providers with whom we share information, we will require them to fulfill the relevant confidentiality obligations and take Appropriate security measures.

 

Third-party social Applications or other services are operated by the relevant third party. Your use of such third party's social services or other services (including any information provided by you to such third parties) is subject to the third party's own terms of service and information protection statement (other than this Agreement), and you need to read its terms carefully. This Agreement Applies only to the Personal Information collected by us and does not Apply to the services provided by any third party or the rules governing the use of information by any third party. If you find that there are risks in these third-party social Applications or other services, you are advised to terminate the relevant operations to protect your legitimate rights and interests.

 

4.1.2 Other circumstances

MobiFitness App may be required to disclose your personal information based on requirements stipulated by laws and regulations, legal procedures, lawsuits, and requirements made by public institutions and government departments according to law. We may also disclose information about you if we determine that disclosure is necessary or Appropriate for the purposes of national security, law enforcement or other matters of public importance.

Although we have taken reasonable and effective measures and have complied with the standards required by relevant laws, please understand that due to technical limitations and possible malicious means, in the Internet industry, even if we do our best to strengthen security measures, it is not always possible to guarantee the security of the information you provide us. We will do our best to ensure the security of the personal information you provide us. Please confirm that you are aware and understand that the system and communication network you use to access our services may have problems due to factors beyond our control. Therefore, we strongly recommend that you take active measures to protect the security of your personal information, including but not limited to not revealing Captchas and other information to others.

C. We will formulate emergency response plans and immediately activate the emergency response plans in the event of user information security incidents, in an effort to prevent the impact caused by such security incidents. In the unfortunate occurrence of user information security event (leakage, loss, etc.), we will, in accordance with the requirements of laws and regulations, timely inform you such as the basic situation of the security event, the possible impact, we have taken or will take measures to deal with, you can independently prevent and reduce the risk of suggestions, remedial measures for you and other information. We will inform you of the relevant situation of the event through SMS, letter, phone call, push notification, etc. When it is difficult to inform the subject of personal information one by one, we will take a reasonable and effective way to release the announcement. At the same time, we will also report the disposal of personal information security incidents in accordance with the requirements of regulatory authorities.

D. What can you do?

You can protect the security of your personal information by not disclosing your login password and other information to anyone (unless that person is formally authorized by you). Whenever you log on to the MobiFitness App using your personal account, especially if you log on to someone else's mobile phone, tablet or public Internet terminal, you should always log out at the end of your use.

MobiFitness App is not liable for security breaches caused by third parties accessing your personal information due to your failure to keep your personal information private. Notwithstanding the foregoing, in the event of any other Internet user's unauthorized use of your account or any other security breach, you should notify us immediately, and your assistance will help us to protect the security of your personal information.

 

6. Minors using our products or services

A. We attach great importance to the protection of minors' information. We assume that you have the corresponding civil capacity in the Internet service. If you are a minor, we require you to carefully read this privacy agreement together under the supervision and guidance of your parents or guardians, and to use our services or provide us with information under the premise of obtaining the consent of your parents or guardians.

B. In the case of collecting personal information of minors using our products or services with the consent of parents or guardians, we will only use or disclose personal data of minors to the extent permitted by law, or to obtain the consent of guardians in accordance with local laws, or for the purpose of protecting minors.

C. We believe it is the responsibility of parents or guardians to supervise minors' use of our products or services. We do not provide services directly to minors, nor do we use their personal information for marketing purposes. If you are the parent or guardian of a minor, and you have any questions about the personal information of the minor under your care, or if you believe that the minor has provided personal information to MobiFitness App, please contact us through the contact information published in Article 9 of this Privacy Agreement.

 

7. Scope of Privacy Agreement

A. Our privacy agreement Applies to all services provided by Shanghai Anytum Network Technology Co., Ltd., including the services provided on MobiFitness App.

B. Our privacy agreement does not Apply to products and services provided by third parties, such as products and services provided by third parties on MobiFitness App. These products, services or websites will be regulated by independent privacy agreements.

 

8. Privacy Agreement Changes

We may modify or update this privacy agreement from time to time. Any update of the privacy agreement will be released in the form of notice and announcement in MobiFitness App. You can visit MobiFitness App to check the latest version of the privacy agreement. For material changes, we will give you serious notice (including for certain services, we will send a notice via SMS or other means to explain the change to the privacy agreement). If you do not accept the revised terms and conditions, please immediately stop using the services provided by MobiFitness App. Users' continued use of the services will be deemed to have accepted the revised agreement.
